Course objectives

The course focuses on the fundamental principles of public regulation of competitive market, network industries providing universal services and the role of regulation authorities, with particular attention to the different models available to guarantee the fulfilment of universal service obligations.

Results of learning outcomes

1) Knowledge and understanding ability.

Students gain learning and comprehension skills in the field of economic law and State intervention rules and regulation.

2) Capability to apply knowledge and understanding

Students are able to critically apply the knowledge learned and particularly gain the ability to apply the studied models both in public and private organizations and to find the adequate economic and judicial tools to solve several different matters deriving from the State intervention in economy.

3) Capability to approach the subject in a critical manner

Students enjoy the ability to critically evaluate topics related to public law for economics and the relationships among State and economic operators as well as the different models of regulation.

4) Communication abilities

Students gain the capacity to understand and to deal with the issues related to State role in economy, as well as to adequately represent the learned knowledge.

5) Learning ability

Students acquire the methodological basis of the juridical research and the capacity to deepen the several issues faced during the course

Oggetto:

Program

The course deals with the evolution of the two main different legal frameworks and roles of regulation: to maintain the competitive structure of markets (i.e. competition law) and to grant quality and affordable prices in network industries that provide utilities. Competition law, as well as the EU principles protecting the internal market, can be limited in order to provide services of general public interest. The course will focus on such limits, on the legal models for public service provision, on the analysis of the use of economic incentives and competitive tools in order to enforce the fulfilment of public service obligation and on the regulation of cross-subsidization. The legal framework concerning the most relevant network industries (e.g. energy, telecommunications, water supply) will be examined in-depth together with the basic principle for managing and exploiting natural resources that make up natural monopolies essential to such economic activities. Further analysis of practical cases and case-law will open further discussion and give the chance for closer examination by students.
